Town of Flower Mound Solicitor Ordinance The Town has recently received several inquiries about handbills and leafleting in Flower Mound. Town attorneys reviewed the matter and indicated that a ban on such handbills and leafleting would be in violation of various provisions of the United States Constitution and other pertinent legislation. Several cases referred to by the town’s attorneys in a legal opinion that was provided are directly on point, and suggest that such an enactment by the Town would subject it to liability and payment of the opposing party’s attorney’s fees. The Town has received several recommendations from residents regarding possible ordinance changes related to handbill solicitation. Staff has prepared a detailed response with legal review to address the recommendations. In addition, a side-by-side comparison of Flower Mound’s solicitation ordinance with the ordinances of Frisco and Highland Village is also available for review. The ordinance was created to sufficiently addresses the solicitation issue by protecting the safety of our residents, while at the same time protecting the rights of business establishments. With regard to door-to-door solicitation, it is unlawful for any person to enter a residential property and ring the doorbell or knock on the door for the purpose of solicitation without first obtaining a permit from the Town, furnishing a bond, and receiving a photo identification badge. The permit and photo identification badge are supplied after a background investigation by the Police Department. An example of a Town-issued solicitor’s badge can be viewed on the Town’s Web site at http://www.flower-mound.com/police/police_solicitors.php. If a citizen has a solicitor knock at their door or ring the doorbell without a permit, the Police Department can be contacted at 972.539.0525.

Door Signs Prohibiting Solicitors
Flower Mound Code of Ordinances Article IV Solicitation Activities sets forth the requirements for vendors soliciting business on residential premises. Sec. 18-263, Exhibiting card prohibiting solicitors, of this Article provides that any person, desiring that no merchant or other person engage in a home solicitation at his residence shall exhibit in a conspicuous place upon or near the main entrance to the residence, a weatherproof card, not less than three inches by four inches in size, containing the words “NO SOLICITORS.” The letters shall not be less than two-thirds of an inch in height. This provision is legally enforceable.
A few Shadow Ridge South homeowners have placed NO SOLICITORS, NO HANDBILLS signs on their front doors. Not only do they not have solicitors knocking, but also the placing of handbills is almost non existent

Stay informed with ELECTRONIC E-MAIL ALERTS
In an effort to effectively notify Flower Mound residents, the Flower Mound Police Department and other area law enforcement agencies send local Home Owner Associations periodic e-mail bulletins to alert residents of criminal activity.
As many of these bulletins are time sensitive, the Shadow Ridge South Homeowners Association (SRSHOA) would like to broadcast these alerts electronically along with other news and information to ensure all homeowners are made aware of events in a timely manner.
SRSHOA is assembling an e-mail distribution list for such announcements. While most residents have publicly supplied their e-mail addresses for publication in the homeowner directory, your inclusion to the “HOA Alert List” is voluntary and requires an e-mail request from the homeowner in order to be added.
If you wish to be added to this list, please send a message to the SRSHOA Manager at SRSHOAMANAGER@verizon.net with “HOA Alert List” in the subject line.
The SRSHOA will not publish, share OR SELL, names on the distribution list. In addition, all e-mail messages will be sent utilizing a BCC option so recipients will not be able to view other homeowners’ e-mail addresses.
The SRSHOA will continue to publish and distribute the newsletter to all residents on a bi-monthly basis.

Prepare your landscaping for Spring
1. Rake your yard to remove thatching that may have occurred. This will allow for a healthy yard. 2. Apply grass seed to bare spots in the yard. Starting grass seed can be accomplished in the spring and fall months depending on the type of grass. 3. Apply fertilizer to suit the type of grass you have. 4. Apply pre-emergent herbicides early to prevent the headache of having to pull weeds. 5. Tune up the lawn mower and yard equipment early in the year to prevent costly repairs or replacement during the summer. 6. Check your sprinkler system to catch any leaks or other problems that could lead to wasted water. 7. Prune trees while they are still dormant to avoid damaging the tree and to more easily visualize the structure of the tree. Pruning also provides sunlight to the grass below trees to prevent bare spots.
